Terms and Conditions

1. INTRODUCTION AND ACCEPTANCE OF TERMS

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and the Buzzio Team ("we", "us", or "our"), the operators of the Buzzio mobile application ("App", "Buzzio", or "Service").

By downloading, installing, accessing, or using Buzzio, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must immediately cease all use of the App and delete it from your device.

We reserve the right to modify these Terms at any time. Continued use of the App after any modifications constitutes acceptance of the updated Terms. It is your responsibility to review these Terms periodically.

2. ELIGIBILITY

You must be at least 12 years of age to use Buzzio. By using the App, you represent and warrant that you meet this age requirement. If you are under the age of 18 (or the age of legal majority in your jurisdiction), you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

We do not knowingly collect personal information from children under 12. If we become aware that a user is under 12, we will terminate their account immediately.

3. DESCRIPTION OF SERVICE

Buzzio is a high-privacy messaging application that allows users to communicate through text messages, images, videos, files, and voice notes. The App also offers an optional, non-custodial Bitcoin wallet for users who choose to activate it. The App is designed with privacy as its core principle.

Privacy Architecture:

Buzzio does not store message content, metadata, or communication logs on its servers.
The only data retained is your account creation time and last login time.
Messages are transmitted between users and are not retained by Buzzio.
Upon report review, only the last 5 messages of a reported conversation are accessible for moderation purposes.

4. USER ACCOUNTS

4.1 Account Creation

To use Buzzio, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4.2 Account Deletion

You may delete your account at any time through the App's settings. Alternatively, you may submit a deletion request to us at app449377@gmail.com. Upon deletion, all associated account data (creation time and last login time) will be permanently removed.

4.3 Account Security

You are solely responsible for safeguarding your account. Buzzio shall not be liable for any loss or damage arising from your failure to maintain the security of your account credentials.

5. USER-GENERATED CONTENT

5.1 Ownership

You retain full ownership of all content you create, send, or share through Buzzio ("User Content"). Buzzio does not claim any ownership, license, or rights over your User Content.

5.2 Responsibility

You are solely responsible for your User Content. You represent and warrant that your User Content does not:

Violate any applicable law or regulation;
Infringe upon the intellectual property rights of any third party;
Contain illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable material;
Contain malware, viruses, or any harmful code;
Exploit or harm minors in any way;
Promote violence, terrorism, or illegal activities.

5.3 No Monitoring

Due to our privacy-first architecture, Buzzio does not proactively monitor, review, or screen User Content. We are not responsible for any User Content transmitted through the App.

6. PROHIBITED CONDUCT

You agree not to:

Use the App for any illegal purpose or in violation of any applicable laws;
Harass, abuse, threaten, or intimidate other users;
Send unsolicited messages (spam) or engage in phishing;
Impersonate any person or entity;
Attempt to gain unauthorized access to the App, other accounts, or related systems;
Reverse engineer, decompile, or disassemble any part of the App;
Use the App to distribute malware or harmful content;
Use the Bitcoin wallet for money laundering, sanctions evasion, fraud, or any illegal financial activity;
Exploit the App for commercial purposes without our written consent;
Circumvent any security features or access controls of the App;
Use automated systems, bots, or scripts to access the App;
Use the App on a rooted (Android) or jailbroken (iOS) device, or on an emulator when using a production build of the App.

6.1 Modified Devices

Buzzio is not supported on rooted, jailbroken, or otherwise compromised devices. We may detect such environments and block or terminate access without notice to protect user security.

7. REPORTING AND ENFORCEMENT

7.1 Reporting

Users may report other users for violations of these Terms. Upon receiving a report, we may review the last 5 messages of the reported conversation to assess the validity of the report.

7.2 Enforcement Actions

If a violation is confirmed, we reserve the right to, at our sole discretion and without prior notice:

Issue a warning to the offending user;
Temporarily suspend the offending user's account;
Permanently ban the offending user's account;
Report illegal activity to relevant law enforcement authorities.

7.3 No Obligation

We are under no obligation to act on any report, and our decision regarding enforcement is final and not subject to appeal.

8. SUBSCRIPTION AND PAYMENTS

8.1 Premium Features

Buzzio offers premium subscription plans:

Monthly Plan: Auto-renewing on a monthly basis.
Yearly Plan: Auto-renewing on an annual basis.

8.2 Payment Processing

All payments are processed exclusively through the Google Play Store. By subscribing, you agree to the Google Play Store's terms of service and payment policies.

8.3 Auto-Renewal

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You may manage or cancel your subscription through your Google Play Store account settings.

8.4 Refunds

All refund requests are handled exclusively by the Google Play Store in accordance with their refund policy. Buzzio does not directly process refunds. We have no obligation to provide refunds or credits for any reason.

8.5 Price Changes

We reserve the right to change subscription pricing at any time. Price changes will take effect at the start of the next subscription period following the date of the price change.

9. BITCOIN WALLET (OPTIONAL)

9.1 Opt-In Only

The Bitcoin wallet is entirely optional. No wallet is created at signup. A wallet is activated only when you explicitly choose to activate it and complete the recovery phrase verification challenge.

9.2 Non-Custodial

Buzzio is not a bank, exchange, broker, custodian, or money transmitter. We never hold, control, or have access to your Bitcoin, private keys, or recovery phrase. You alone are responsible for custody of your funds.

9.3 Same Recovery Phrase, Separate Keys

The wallet uses the same 12-word recovery phrase as your messaging identity, but Bitcoin keys are derived on a separate industry-standard BIP-84 path. Messaging encryption keys are not reused for Bitcoin.

9.4 Your Responsibilities

By activating or using the wallet, you agree that you are solely responsible for:

Securely backing up your recovery phrase — loss of the phrase means permanent loss of Bitcoin with no recovery by us;
Verifying recipient addresses and amounts before every transfer;
Understanding that mainnet Bitcoin transactions are irreversible;
Compliance with all applicable laws, taxes, sanctions, and regulations in your jurisdiction;
Securing your device against theft, malware, and unauthorized access.

9.5 Mutual Contact Address Sharing

If you activate the wallet, your public Bitcoin receive address may be published to mutual contacts (users who have messaged each other) who have also enabled the wallet, solely to allow sending Bitcoin between contacts. You consent to this by activating the wallet.

9.6 Third-Party Blockchain Services

The wallet syncs balances and broadcasts transactions via public blockchain APIs (e.g. Blockstream Esplora). Optional fiat price display may use third-party price feeds (e.g. CoinGecko). We do not control the Bitcoin network or these third-party services.

9.7 No Financial Advice

Buzzio does not provide investment, tax, accounting, or legal advice. Any fiat value shown is an approximate reference only and may be inaccurate or unavailable.

9.8 Wallet Age Requirement

You must be at least 18 years of age (or the age of legal majority in your jurisdiction) to activate the Bitcoin wallet. If local law requires a higher age for cryptocurrency services, you must meet that requirement.

9.9 No Warranty on Wallet

THE BITCOIN WALLET IS PROVIDED "AS IS" WITHOUT WARRANTY. We do not guarantee uninterrupted sync, accurate fee estimates, successful broadcasts, or protection against loss due to user error, device compromise, network congestion, or third-party API failures.

10. INTELLECTUAL PROPERTY

10.1 Buzzio's Intellectual Property

The App, including its design, code, features, logos, trademarks, and all related intellectual property, is owned exclusively by us. Nothing in these Terms grants you any right to use Buzzio's name, logos, or trademarks.

10.2 Restrictions

You may not copy, modify, distribute, sell, lease, or create derivative works based on the App or any part thereof without our prior written consent.

11. THIRD-PARTY SERVICES

Buzzio utilizes Firebase (provided by Google) for certain backend functionalities. The optional Bitcoin wallet may use public blockchain APIs (such as Blockstream Esplora) and optional price data providers (such as CoinGecko). Your use of the App is also subject to Google's Terms of Service and Privacy Policy. We are not responsible for the practices, policies, availability, or content of any third-party services, including blockchain networks and public API providers.

12. DISCLAIMER OF WARRANTIES

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT;
WARRANTIES THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS;
WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY CONTENT TRANSMITTED THROUGH THE APP;
WARRANTIES THAT THE APP WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS;
WARRANTIES REGARDING THE SECURITY OF YOUR COMMUNICATIONS OR DATA.

YOU ACKNOWLEDGE THAT YOU USE THE APP ENTIRELY AT YOUR OWN RISK. We do not warrant that the privacy features of the App will be impenetrable or that communications cannot be intercepted by third parties through means outside our control. We do not warrant the security, availability, or accuracy of the Bitcoin wallet or any blockchain-related functionality.

13. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

13.1 Exclusion of Damages

IN NO EVENT SHALL WE, OUR AFFILIATES, OR OUR AGENTS BE LIABLE FOR ANY:

INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES;
LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES;
COST OF SUBSTITUTE SERVICES;
DAMAGES ARISING FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR COMMUNICATIONS;
DAMAGES RESULTING FROM ANY USER CONTENT OR CONDUCT OF ANY THIRD PARTY;
DAMAGES ARISING FROM ANY INTERRUPTION, SUSPENSION, OR TERMINATION OF THE SERVICE;
LOSS OF BITCOIN OR OTHER DIGITAL ASSETS, INCLUDING DUE TO LOST RECOVERY PHRASES, INCORRECT ADDRESSES, UNAUTHORIZED DEVICE ACCESS, BLOCKCHAIN DELAYS, OR THIRD-PARTY API FAILURES.

REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE), EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

13.2 Maximum Liability Cap

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE APP EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR TEN US DOLLARS (USD $10.00), WHICHEVER IS GREATER.

13.3 Essential Purpose

THE LIMITATIONS IN THIS SECTION SHALL APPLY EVEN IF ANY LIMITED REMEDY FAILS OF ITS ESSENTIAL PURPOSE.

14. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless the Buzzio Team, and any future affiliates, officers, agents, and employees from and against any and all claims, demands, actions, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

Your use or misuse of the App;
Your User Content;
Your violation of these Terms;
Your violation of any applicable law, regulation, or third-party rights;
Any dispute between you and another user of the App;
Any claim that your User Content caused damage to a third party;
Your negligent or wrongful conduct;
Your use of the Bitcoin wallet, including any transaction you initiate or fail to initiate.

This indemnification obligation shall survive the termination of your account and these Terms.

15. DISPUTE RESOLUTION AND ARBITRATION

15.1 Mandatory Arbitration

ANY DISPUTE, CONTROVERSY, OR CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE APP SHALL BE RESOLVED EXCLUSIVELY THROUGH BINDING ARBITRATION, rather than in court, except that you may assert claims in small claims court if your claims qualify.

15.2 Waiver of Class Action

YOU AND WE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

15.3 Arbitration Procedure

Arbitration shall be conducted in accordance with the arbitration laws of Sri Lanka.
The arbitration shall take place in Sri Lanka.
The arbitration shall be conducted in English.
The arbitrator's decision shall be final and binding.
Judgment on the arbitration award may be entered in any court having jurisdiction.

15.4 Pre-Arbitration Requirement

Before initiating arbitration, you must first send a written notice of the dispute to app449377@gmail.com describing the nature of the claim and the relief sought. Both parties agree to attempt to resolve the dispute informally for at least 30 days before initiating arbitration.

16. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the Democratic Socialist Republic of Sri Lanka, without regard to its conflict of law principles.

17. TERMINATION

17.1 By You

You may terminate your agreement with us at any time by deleting your account and uninstalling the App.

17.2 By Us

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including but not limited to a breach of these Terms.

17.3 Effect of Termination

Upon termination:

Your right to use the App ceases immediately;
All provisions of these Terms which by their nature should survive termination shall survive (including Limitation of Liability, Indemnification, Dispute Resolution, and Governing Law).

18. SEVERABILITY

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

19. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding your use of the App and supersede all prior agreements, understandings, and communications.

20. NO WAIVER

The failure of us to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by us.

21. ASSIGNMENT

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction (including to a future registered company entity).

22. FORCE MAJEURE

We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, cyberattacks, government actions, or failures of third-party services.

24. ACKNOWLEDGMENT

BY USING BUZZIO, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS AND CONDITIONS, UNDERSTAND THEM, AND AGREE TO BE BOUND BY THEM. YOU FURTHER ACKNOWLEDGE THAT THESE TERMS CONSTITUTE THE COMPLETE AND EXCLUSIVE STATEMENT OF THE AGREEMENT BETWEEN YOU AND US, SUPERSEDING ANY PRIOR AGREEMENTS OR PROPOSALS.
